ニカラグアの人工妊娠中絶についての行動要請

人工妊娠中絶が全面禁止されているニカラグアでは、妊娠の継続が女性の生命身体に危険を及ぼす場合にも、中絶が禁止され処罰の対象とされています。そのような場合の非犯罪化を求める行動要請です。

Place the life of a Nicaraguan women in the hands of the Inter-American Commission of Human Rights (IACH)

23 February 2010. Women’s Link Worldwide along with other organizations, which form part of the Strategic Group for the Decriminalization of Therapeutic Abortion in NICARAGUA, including the Nicaraguan Center for Human Rights, the OB-GYN Society, the New Family Association (ANFAN) in addition to other international organizations, the Center for Justice and International Law (CEJIL) and IPAS Center America, requested the Inter-American Commission of Human Rights to order the Nicaraguan government to adopt urgent precautionary measures to protect the life of a 27-year-old Nicaraguan woman, mother of a 10-year-old child. She was refused a therapeutic abortion by the health care system despite the fact that she needs chemotherapy and radiotherapy cancer treatment. The therapeutic abortion was denied due to the fact that since 2006 abortion in Nicaragua is illegal in all circumstances. It is not even permitted in order to save the life of the woman as in this case.

On February 18th the organizations filed the request for urgent precautionary measures before the IACH and they expect that within the next few days the Commission will issue a decision demanding the Nicaraguan government to take urgent measures directed at saving the woman’s life.

Women’s Link Worldwide has provided technical assistance to the Strategic Group for the Decriminalization of Therapeutic Abortion since the passage of the law that prohibited the availability of therapeutic abortion in October 2006. Women’s Link helped to draft a petition challenging the constitutionality of the law, we provided support in presenting amicus curiae briefs by various international experts and worked with the group on some aspects of their communications strategy. The lack of concrete answers within the country and the particular urgency of the situation, led us to present the case with the Strategic Group for the Decriminalization of Therapeutic Abortion.

We urgently call on all persons and organizations interested in the case to please write to the President of the Commission, Luz Patricia Mejia Guerrero and to the Commissioner on Nicaragua, Felipe Gonzalez requesting a rapid and positive response to the request for the adoption of precautionary measures.
